- The client typically acts as the initial trustee, maintaining the authority to manage, buy, sell, or move assets in and out of the trust during their life.
- A successor trustee, designated by the client, automatically takes over if the client becomes incapacitated or passes away, enabling private and seamless management of assets without court intervention or probate.
- Assets in the trust avoid the probate process, enabling faster and often less expensive transfer to beneficiaries.
- The trust document and its distributions remain private and do not become part of a public record, unlike a will that is probated.
